LSC STANDARD WARRANTY

LIMITED WARRANTY

LSC Control Systems Pty Ltd ABN 21 090 801 675, trading as LSC Control Systems (LSC), hereby warrants that all products manufactured by LSC and products distributed by LSC as the authorised distributor of Robe and Avolites products in Australia and New Zealand (Goods) will be free from defects in workmanship and materials affecting normal use subject to the conditions and limitations provided in this limited warranty (Warranty).


WARRANTY CONDITIONS

  1. Persons covered by this Warranty:
    1. The original purchaser of the Goods;
    2. Persons who purchase the Goods from LSC or an authorised LSC, Robe or Avolites dealer located in Australia or New Zealand;
    3. Persons to whom the title to or the property in the Goods has been legally transferred but only for the balance of the Warranty so remaining.
  2. This Warranty covers the cost of all parts and labour provided by LSC.
  3. LSC reserves the right, at its sole discretion, to:
    1. repair or replace defective Goods; or
    2. refuse any warranty claims made other than in accordance with this Warranty.
  4. The purchaser (you) must contact LSC or your LSC dealer or reseller (Agent) regarding any defect claimed under this Warranty.
  5. At LSC's request you must return to LSC, or the Agent as directed, any Goods claimed to be defective in accordance with the terms and conditions of this Warranty.
  6. Any Goods or components returned shall be at your risk whilst in transit both to and from LSC.
  7. You are responsible for all transport and insurance costs to send Goods to LSC and for their return and all freight charges must be prepaid.
  8. You agree to pay all costs for repairs, modifications, or upgrades that you request that are not in accordance with this Warranty.

WARRANTY LIMITATIONS

  1. Certain rights, guarantees, conditions, warranties and obligations are implied byAustralian and New Zealand law including the Australian Consumer Law and the NewZealand Consumer Guarantees Act 1993, and cannot be excluded or modified (the Statutory Rights). All warranties expressly given by LSC in this Warranty, other thanthe Statutory Rights, are collectively referred to as "Express Warranties". Any ExpressWarranties are given in addition to and without derogation from the Statutory Rights.Other than the Express Warranties and the Statutory Rights, LSC gives you no warranties, in respect of the Goods, whether express or implied by operation of law or otherwise, including, without limitation, warranties of merchantability and fitness fora particular purpose, satisfactory quality and/or compliance with description, in respect of any Goods manufactured by LSC or for which LSC is the authorised distributor or reseller.
  2. To the extent permitted by law, and subject to any Statutory Rights that cannot be excluded, restricted or modified, LSC's liability for a breach of any Express Warranty is limited to:
    1. the repair or replacement at LSC's option of such parts as shall be determined to be defective on LSC's inspection. Such repairs may be performed with re-worked or refurbished parts;
    2. the replacement of the Goods;
    3. the supply of equivalent Goods or,
    4. at LSC's sole discretion, the payment of:
      1. the cost of replacing the Goods;
      2. the cost of acquiring equivalent Goods; or
      3. the cost of having the Goods repaired.
  3. To the fullest extent permitted by law, this Warranty does not apply, and LSC'sobligations under this Warranty do not extend, to:
    1. any Goods purchased at auction;
    2. any Goods obtained illegally or reported to LSC as having been stolen;
    3. any Goods for which LSC is not the manufacturer or the authorised distributor or reseller in Australia and New Zealand;
    4. any Goods purchased outside Australia or New Zealand and subsequently imported into Australia or New Zealand by the purchaser, including second-handGoods and Goods acquired through unofficial or unauthorised distribution channels; or
      1. an act or default of any person other than LSC or LSC's agent; or
      2. damage by or subject to accident, negligence, alteration, abuse or misuse, or any accessories or parts not supplied by LSC; or
      3. any damage to any product or part of a product caused by or due to an act ofGod, any catastrophe resulting from earthquake, fire, flood, explosion or any other cause beyond the control of LSC;
      4. any components which may be warranted directly to the Customer by the original manufacturer;
      5. any Goods acquired other than through LSC or an authorised LSC, Robe or Avolites dealer in Australia or New Zealand.
  4. The Express Warranties do not apply, and LSC's obligations under this Warranty do not extend, to:
    1. fuses and disposable batteries supplied with any Goods;
    2. adjustments, repairs, alterations or modifications or attempted adjustments, repairs, alterations or modifications to Goods, undertaken by you or by a person not authorised by LSC, outside LSC's premises, or without written authority fromLSC obtained prior to any such adjustment, repair, alteration or modification;
    3. any damage, fault, malfunction or failure of the Goods as a result of normal wear and tear or the neglect, misuse, abuse or failure to properly service Goods by you; and
    4. Goods if any of LSC's trade mark, trade name, logo or serial number has beenremoved or defaced or otherwise does not exist on the relevant Goods.
  5. LSC will not assume any responsibility for any labour expended or materials used to repair any equipment without LSC's prior written authorisation.
  6. TO THE FULLEST EXTENT PERMITTED BY LAW, AND SUBJECT TO THE STATUTORY RIGHTS THAT CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED, LSC SHALL NOT BE RESPONSIBLE FOR ANY INCIDENTAL, GENERAL OR CONSEQUENTIAL DAMAGES, DAMAGES TO PROPERTY, DAMAGES FOR LOSS OF USE, TIME, PROFITS OR INCOME, OR ANY OTHER DAMAGES.

Australia: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

New Zealand: Nothing in this Warranty limits any rights or remedies available under the Consumer Guarantees Act 1993 (NZ) or other applicable New Zealand consumer protection legislation.
